Environmental Regulation; Prohibiting a county from requiring an applicant to obtain a permit or approval from any state or federal agency as a condition of processing a development permit under certain conditions; requiring that the Department of Environmental Protection review an application for certain permits under the Beach and Shore Preservation Act and request additional information within a specified time; requiring that certain counties or municipalities apply by a specified date to the department or water management district for authority to require certain permits; providing for issuance of general permits for the construction, alteration, and maintenance of certain surface water management systems without the action of the department or a water management district; revising the deadline for completion of the installation of fuel tank upgrades to secondary containment systems for specified properties, etc.

SB 842: Growth Management - Sponsored by Bennett
Growth Management; Repealing provisions relating to the powers and duties of the Secretary of Community Affairs and functions of the Department of Community Affairs with respect to federal grant-in-aid programs; replacing references to the Department of Community Affairs with state land planning agency; repealing provisions relating to the Urban Infill and Redevelopment Assistance Grant Program; deleting provisions relating to the Coastal Resources Interagency Management Committee; deleting provisions excluding a municipality that is not a signatory to a certain interlocal agreement from participating in a school concurrency system; replacing references to the Department of Community Affairs with the Department of Economic Opportunity; deleting requirements for interlocal agreements relating to public education facilities, etc.

Growth Management; Prohibits local government from applying transportation or school concurrency or requiring proportionate-share contribution or construction for new developments for specified period; provides exception; provides for extension of prohibition under certain conditions; provides application; provides for future expiration; prohibits certain counties, municipalities, & special districts from imposing certain new or existing impact fees for specified period; provides for extension of prohibition under certain conditions; provides application; provides for future expiration.
Effective Date: July 1, 2012
HB 869: Pinellas Planning Council, Pinellas County - Sposnored by Frishe; Hooper
Pinellas Planning Council, Pinellas County; Codifies, amends, reenacts, & repeals district's special acts; reorganizes council; provides intent that countywide plan be broadly defined & policy-based; provides that primary focus of council be land use & transportation planning; provides that membership of council be same as that of county MPO; provides for election of officers, council meetings, quorum requirements, & member expenses; provides for council powers & duties, including revising required components of countywide plan, consistent with stated legislative intent; provides for countywide staff & committees; provides for budget & annual independent audit; recognizes countywide planning authority of board of county commissioners as provided by county charter; provides for repeal of existing countywide plan, adoption of new countywide plan, future amendment of plan, & standards & procedures for such actions; provides timetable for consistency review after adoption of new countywide plan; provides for public hearing & notice requirements; requires authority to adopt specific notice standards in countywide rules; provides for compliance with pt. II, ch. 163, F.S., relating to growth policy.
Effective Date: upon becoming a law or upon the final approval of the Pinellas County Metropolitan Planning Organization's reapportionment plan increasing its membership from 11 to 13 members ("the MPO reapportionment plan"), whichever occurs later.

Neighborhood Improvement Districts; Renaming the “Safe Neighborhoods Act” as the “Neighborhoods Improvement Act”; requiring each neighborhood improvement district authorized under law to notify the Department of Economic Opportunity and the Department of Legal Affairs of its existence rather than to register with such departments; revising provisions authorizing a local governing body to create a local government neighborhood improvement district, etc.

SB 840: Community Redevelopment Agencies - Sponsored by Diaz de la Portilla
Community Redevelopment Agencies; Providing reporting requirements for certain community redevelopment agencies; providing for the termination of community redevelopment agencies by the board of county commissioners of certain counties; providing public hearing and notice and termination plan requirements; providing that consent from certain entities is not required for such termination; providing additional redevelopment plan requirements for certain counties; providing requirements for the expenditure of moneys from redevelopment trust funds in certain counties; exempting payment of debt service in such counties from certain approval; providing requirements for the appropriation of certain trust fund moneys in such counties; requiring a forensic audit of agencies in such counties at least every 5 years for certain purposes, etc.
