Community Redevelopment Agencies; Provides reporting requirements for certain community redevelopment agencies; provides for termination of community redevelopment agencies by board of county commissioners of certain counties; provides public hearing & notice & termination plan requirements; provides that consent from certain entities is not required for such termination; provides additional redevelopment plan requirements for certain counties; provides requirements for expenditure of moneys from redevelopment trust funds in certain counties; exempts payment of debt service in such counties from certain approval; provides requirements for appropriation of certain trust fund moneys in such counties; requires forensic audit of agencies in such counties at least every 5 years for certain purposes.

Public Housing; Providing that access to essential commercial goods and services for persons of low income served by housing authorities is a public use; revising the definition of the term “housing project”; defining the term “essential commercial goods and services”; prohibiting the use of eminent domain for certain purposes; revising and providing findings and declarations of property of tax exemption for housing authorities relating to access to essential commercial goods and services necessary for daily living for persons of low income, etc.

Effective Date: July 1, 2012

HB 933: Public Housing - Sponsored by Rouson
Public Housing; Provides that access to essential commercial goods & services for persons of low income served by housing authorities is public use; prohibits use of eminent domain for certain purposes; expands certain powers of housing authorities to include certain commercial projects providing essential goods & services; provides for use of revenues received from projects; reenacts provision relating to tax exemptions applicable to housing authorities created pursuant to certain federal programs; provides that there exists shortage of access to essential commercial goods & services necessary for daily living for persons of low income; expands certain powers of state public bodies to include certain commercial projects providing essential goods & services; revises & provides findings & declarations of property of tax exemption for housing authorities relating to access to essential commercial goods & services necessary for daily living for persons of low income; exempts certain commercial projects that allow access to essential goods & services for persons of low income residing in such housing projects from certain taxes & special assessments.

Effective Date: July 1, 2012

SB 1616: Tax Exemptions for Building Materials - Sponsored by Siplin
Tax Exemptions for Building Materials; Providing that a copy of any valid permit issued by the county or municipal building department for rehabilitation of real property in an enterprise zone satisfies the requirement that a valid permit be included as part of an application for a refund of the sales and use tax on building materials; clarifying that the exemption for building materials used in an enterprise zone applies to the use tax and not just the sales tax; revising the definition of the term “building materials” to expand the scope of the sales or use tax exemption to include building materials that become a component part of housing project or mixed-use project developments, etc.

Effective Date: July 1, 2012

Tax Exemptions for Building Materials; Provides that copy of any valid permit issued by county or municipal building department for rehabilitation of real property in enterprise zone satisfies requirement that valid permit be included as part of application for refund of sales & use tax on building materials; clarifies exemption for building materials used in enterprise zone applies to use tax & not just sales tax; revises definition of term "building materials" to expand scope of sales or use tax exemption to include building materials that become component part of housing project or mixed-use project developments; revises definition of term "housing project" to include conversion of other buildings for purposes of redevelopment; revises definition of "mixed-use project" to include conversion of other buildings for purposes of redevelopment & expand required square footage set aside by developer to include certain housing construction in designated brownfield area; clarifies that exemption for building materials in redevelopment projects applies to use tax & not just sales tax; specifies that other documents reflecting payment of sales or use tax, not just invoices evidencing payment of tax, satisfy requirements relating to filing of application for refund of sales or use tax paid on building materials in redevelopment projects.

Effective Date: July 1, 2012

SB 1180: Developments of Regional Impact - Sponsored by Bennett
Developments of Regional Impact; Requiring that plan amendments proposing a development that is exempt from review as a development of regional impact follow the state coordinated review process; requiring that reviewing agencies make only recommendations and comments regarding a proposed development which are consistent with statutes, rules, or adopted local ordinances that are applicable to all developments in the jurisdiction where the proposed development is located; providing legislative intent regarding the issues that may be considered during the development-of-regional-impact review process; requiring that a local government having jurisdiction rescind a development-of-regional-impact development order, upon request, and upon a showing that all required mitigation related to the amount of development that existed on the date of rescission will be completed under a permit or other authorization issued by a governmental agency, etc.

Effective Date: July 1, 2012

HB 979: Developments of Regional Impact - Sponsored by Diaz
Developments of Regional Impact; Requires comprehensive plan amendments proposing certain development to follow state coordinated review process; limits scope of certain recommendations & comments by reviewing agencies regarding proposed development; revises provisions relating to regional planning agency reports; provides that specified changes to development orders are not substantial deviations; provides exemption from development-of-regional-impact review for certain proposed development; provides conditions under which certain local governments are required to rescind development-of-regional-impact development orders.

CS/SB 156: Assessment of Residential and Nonhomestead Real Property - Sponsored by Community Affairs; Latvala
Assessment of Residential and Nonhomestead Real Property; Excluding the value of certain improvements from the assessed value of residential real property; specifying a limitation on the assessed value of residential real property; providing for application of the assessment limitations; requiring a nonrefundable filing fee for a petition to the value adjustment board; specifying additional exceptions to the assessment of homestead property at just value; specifying additional exceptions to assessment of nonhomestead property at just value; providing for the continuity and apportionment of assessment limitations on combined and divided parcels; repealing provisions relating to the property tax exemption for renewable energy source devices, etc.

Effective Date: July 1, 2012, and applies to assessments beginning January 1, 2013

Assessment of Residential and Nonhomestead Real Property; Limits review of changes to assessed or taxable value of real property resulting from informal conferences to review by DOR; excludes value of certain improvements from assessed value of residential real property; specifies limitation on assessed value of residential real property; provides for application of assessment limitations; provides procedural requirements & limitations; requires nonrefundable filing fee for petition to value adjustment board; specifies additional exceptions to assessment of nonhomestead property at just value; defines term "placed on tax roll"; provides for continuity & apportionment of assessment limitations on combined & divided parcels; specifies when divided or combined parcels must appear as combined or divided on tax roll; deletes definition of terms "renewable energy source device" & "device"; repeals provisions relating to property tax exemption for renewable energy source devices; provides for application.
